Property Disputes and Illegal Possession of NRI-Owned Property

Property disputes dominate the legal concerns of UAE-based NRIs, many of whom have worked in the Gulf for one or two decades while ancestral land or a family house in Kerala, Punjab, Uttar Pradesh, or Andhra Pradesh remained in a relative's care. It is extremely common for that relative to refuse to vacate, rent out the property without sharing proceeds, or attempt to sell it using a forged Power of Attorney. Recovery of possession is pursued through a suit under the Specific Relief Act, 1963, generally paired with an interim injunction under Order 39 of the Code of Civil Procedure to stop any sale, mortgage, or construction while the case is pending. Where several siblings or relatives hold shares in undivided property, a partition suit properly divides ownership. UAE-based NRIs who purchased flats in Kochi, Lucknow, or NCR townships and face builder delays can file a complaint before the state RERA authority under the Real Estate (Regulation and Development) Act, 2016, which is usually faster than ordinary civil litigation. We verify title at the Sub-Registrar's office, issue legal notices, and represent UAE clients at every hearing through a registered Power of Attorney, with our Dubai office available for in-person coordination when useful.

Succession, Inheritance and Legal Heir Certificates

When a parent or relative in India dies intestate, UAE-based NRI heirs typically need a succession certificate or legal heir certificate to access bank deposits, agricultural land, or urban property. This is governed by the Indian Succession Act, 1925, and for Hindus, the Hindu Succession Act, 1956, which since its 2005 amendment gives daughters equal coparcenary rights. Where a will exists, we handle probate, and where property is spread across multiple states, we coordinate filings in each jurisdiction — all pursued through a Power of Attorney so a trip to India is not required for the process to move forward.

Power of Attorney and Attestation via the Dubai Associate Office and Indian Mission

A Power of Attorney executed in the UAE must be attested before it can be used for property registration or litigation in India. This is done at the Consulate General of India in Dubai or the Embassy of India in Abu Dhabi, typically through booking an appointment, signing before the consular officer with two witnesses, and paying the attestation fee (often processed via the eSanad platform for eligible documents). Because we maintain a dedicated associate office in Dubai, we can meet UAE-based clients in person to finalise the POA draft and coordinate the consular appointment before the document is couriered to India for stamping under the applicable state Stamp Act and registration under the Registration Act, 1908.

Cheque Bounce and Money Recovery

Cheque bounce and money recovery disputes are especially common among UAE-based NRIs who have lent money to relatives, sold property, or rented out flats in India. A criminal complaint under Section 138 of the Negotiable Instruments Act, 1881 can be filed through a Power of Attorney holder or advocate, and we handle the entire recovery process, including interest and costs, while you remain in the UAE.
