Can an NRI fight a property case in India without traveling back?

Yes. Indian courts routinely permit litigants to appear through Power of Attorney holders and, since the pandemic, allow video conferencing for hearings and even witness testimony in many cases. Most of our NRI clients manage their entire case from abroad with only occasional need to travel, usually only for a mediation or final settlement signing.

How do I give Power of Attorney for my India property from abroad?

You execute the Power of Attorney document and get it attested at the Indian Consulate or Embassy in your country of residence, after which it is adjudicated and registered in India under the Registration Act, 1908 and the Power of Attorney Act, 1882. We prepare the draft, coordinate the consulate appointment, and handle registration in India on your behalf.

What should I do if a relative has illegally occupied my property in India?

Do not attempt informal settlement alone from abroad. We recommend sending a formal legal notice, gathering title documents, and if needed filing a suit for possession or an injunction under the Specific Relief Act and CPC Order 39. Acting early materially improves the outcome and prevents adverse possession claims from strengthening.

Do I need to be physically present in India for a succession or inheritance case?

No. Under the Indian Succession Act, 1925 and Hindu Succession Act, 1956, an NRI legal heir can obtain a succession certificate or legal heir certificate, and pursue probate of a will, through an authorized Power of Attorney holder or advocate, with your instructions given over video call.

Can NRIs get a mutual consent divorce in India while living abroad?

Yes, subject to jurisdictional requirements under the Hindu Marriage Act or applicable personal law. Many steps can be handled via video conferencing and authorized representation, though at least one brief appearance is often required at the final stage depending on the court.

What happens if I ignore a builder's delay in handing over possession?

Delays can be challenged before the Real Estate Regulatory Authority (RERA) under RERA, 2016, which allows for refund with interest or compensation. Waiting too long can complicate evidence collection, so NRIs should document delays and file a RERA complaint promptly.

Will Indian tax or FEMA rules affect my property or fund transfer?

Yes. Sale of property by an NRI attracts TDS under the Income Tax Act, 1961 and repatriation of proceeds is governed by FEMA, 1999 and RBI regulations. We coordinate with chartered accountants to ensure compliant, efficient repatriation.
